Terms of Service

The short version

These Terms of Service ("Terms") are an agreement between you and DriveTimeTracker ("we", "us") covering the DriveTimeTracker app at drivetimetracker.app, the website at drivetimetracker.com, and related services (together, the "Service"). By creating a profile, redeeming an invite, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

Drivers can use the Service without an email address; the app stores a sign-in token on your device. If you lose that device without having added an email, we may not be able to recover your log — add an email in Settings if you want that protection. Supervisors sign in with a one-time code sent to their email. You're responsible for keeping your email account and your device secure, and for everything done through your account. Tell us right away at hello@drivetimetracker.app if you think someone else is using it.

3. Logs, confirmations, and the DMV

The Service is a record-keeping tool. It is not a driver-education program, a licensed driving school, a government service, or a substitute for your state's official requirements.

4. Sharing between users

When a driver shares an invite code or link, anyone who redeems it can see that driver's name and complete driving log and can confirm drives. Drivers should share codes only with people they trust, and can remove a supervisor at any time in Settings. Supervisors agree to use a driver's information only to support that driver's learning and licensing, and not to share it further without the driver's (or, for a minor, their parent's) consent. If a driver connects a driving school, the school may see the driver's log for the same purpose.

You own the information you put into the Service — your drives, notes, and names. You give us permission to store, process, display, and transmit it as needed to run the Service and as described in the Privacy Policy, including showing it to the supervisors and schools you link. We may use aggregate, de-identified statistics for any purpose.

7. Our content

The Service — its design, code, logo, and text — belongs to us or our licensors and is protected by copyright and trademark law. You may use it only as these Terms allow. "DriveTimeTracker" and the stopwatch-road logo are our trademarks; please don't use them in a way that suggests we endorse you or your business without asking.

8. Partners and third parties

We may show adults offers from partners such as driving schools and insurance providers, and may share adults' contact information with them as described in the Privacy Policy. We never share information about drivers under 18 with partners. Partners are independent businesses; we're not responsible for their products, prices, or conduct, and any agreement you make with them is between you and them. The Service may also link to third-party websites we don't control.

9. Fees

The Service is currently free. We may introduce paid features, subscriptions, or fees charged through a partner such as a driving school. If we do, we'll describe what costs money and how much before you're charged, and these Terms will be updated with payment terms. We won't charge you for something you didn't knowingly choose.

10. Ending your use

You can stop using the Service any time and can delete your account by emailing us. We can suspend or close accounts that violate these Terms, put other users at risk, or are used unlawfully, and may remove false or abusive content. If we discontinue the Service, we'll give reasonable notice and a chance to export your log where practical. Sections 3, 6, 7, 11, 12, 13, and 14 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DATA WON'T BE LOST; OR THAT ANY LICENSING AUTHORITY WILL ACCEPT A LOG OR EXPORT FROM THE SERVICE. SOME STATES DON'T ALLOW THESE DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST TIME, DELAYED LICENSING, OR ANY INJURY, ACCIDENT, OR PROPERTY DAMAGE ARISING FROM DRIVING, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE, AND EXCEPT WHERE THE LAW DOESN'T ALLOW THEM.

13. Indemnity

If you're an adult, you agree to defend and hold us harmless from claims and costs (including reasonable attorneys' fees) arising from your violation of these Terms, your false entries or confirmations, or your misuse of another person's information obtained through the Service. A parent who agrees to these Terms for a minor driver takes on this obligation for that driver's use.

14. Disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Before filing any claim, you agree to email us and give us 30 days to try to resolve it informally. Any claim that isn't resolved will be brought in the state or federal courts located in the State of Washington, and you consent to their jurisdiction — except that either of us may bring an individual claim in small-claims court. Claims must be brought individually, not as a class or representative action, where the law allows.

15. Changes to these Terms

We may update these Terms. For meaningful changes we'll update the date at the top and notify supervisors by email or in the app before the change takes effect. Continuing to use the Service after that means you accept the updated Terms.

16. Everything else

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a court finds part of these Terms unenforceable, the rest stays in effect. If we don't enforce a provision, we're not waiving it. You can't transfer your rights under these Terms; we may transfer ours to a successor that agrees to honor them.
